Professional standards in marine industry: historical development of the legal regulation and modern renewal

Abstract

The article is devoted to the research of forming of genesis of professional standards for seafarers, and also, their next fixing in the national legislation of states and international agreements. The role of the International Labour Organization and the International Maritime Organization in the forming of a system of such standards is mentioned. The special attention is paid to the necessity of joining Ukraine to the Convention of the International Labour Organization 2006 about labour in marine navigation, as it will provide a long ago expected and supported by most naval powers vault of standards of terms of life and labour on ships to Ukrainian seafarers. In addition, the author examines the problems of implementation the conventions, dedicated to the determination of professional standards for a seafarer (STCW and STCW – F) to the Ukrainian legislation. At the research of these agreements the author marks that confirmations of diplomas of seafarers are given out only at a presence of a writing memorandum between a country, that gave a diploma to a seafarer and a country that acknowledges a diploma of a seafarer. Such memorandums about acknowledgement of the Ukrainian diplomas of seafarers, according to the information placed on the official web – site of the Inspectorate for Training and Certification of Seafarers of the Ministry of Infrastructure of Ukraine, on present tense are signed with 53 countries, memorandums about acknowledgements of diplomas of seafarers of other states are signed by Ukraine with 19 states – members of the IMO (Azerbaijan, Morocco, Mongolia, Vietnam, the Comoros islands, the Czech Republic, Israel, the Philippines, Switzerland, Finland and others).
