Abstract
This draft position of the Sejm concerns the motion filed by the Council of the Municipality of Kobylnica on 6th October 2015. In the proposed draft position the author claims that the contested Article 129b para. 2 subpara. 1 of the Law on Road Traffic, insofar as it does not confer the power to control the road traffic using the recording devices to municipal (or city) guard, is in compliance with the Constitution. In the remaining scope of the motion the proceedings should be discontinued pursuant to the Article 40 para. 1 subpara. 1 of the Act of 22th July 2016 on the Constitutional Tribunal due to the inadmissibility of the judgment.
