PROTECTION OF MINERAL DEPOSITS IN THE STUDY OF CONDITIONS AND DIRECTIONS OF SPATIAL MANAGEMENT IN THE CONTEXT OF THE PRINCIPLE OF SUSTAINABLE DEVELOPMENT

Abstract
The paper deals with selected provisions of the legal act of March 27, 2003, The Planning and Spatial Development, and the law of June 9, 2011, The Geological and Mining Law on the protection of mineral deposits in the study of conditions and directions of spatial management. In the conclusions to the acts a view is expressed that the study of conditions and directions of spatial development of municipalities should also take into account the mineral deposits which have not yet been documented. This is required by the regulation contained in Art. 5 of the Polish Constitution of April 2, 1997, which imposes on all authorities of the State the duty to protect the environment in accordance with the principle of sustainable development.
