Public Participation in the Implementation of Penalties and Measures of a Libertarian Nature in the Polish Legal System

Abstract

The subject matter of the article is to present the issue of public participation in the enforcement of penalties and measures taken by the court against convicted persons, which are carried out at large. The Executive Penal Code applicable in Poland, taking into account international standards in this respect, provides for such a possibility. The article attempts to look at how these types of tasks are implemented. The article first presents the legal framework for public participation in the implementation of penalties and measures. Then, the concept of society’ was analysed under the Executive Penal Code and it points out the penalties and measures in which the society could participate. The article also presents the methods and forms of this participation. It ends with conclusions and proposals to introduce changes to the current system in order to encourage representatives of the public to become more involved in the implementation of punishments and liberties.
