QUESTIONS OF CONTRIBUTIONS TO ELECTION FUNDS DURING PARLIAMENTARY AND LOCAL ELECTIONS

Abstract

The article is devoted to investigation of such income to election funds as voluntary contribution of individuals and legal entities, contributions of political parties and local parties’ organizations and elective candidates – election process subjects (personal funds) during parliamentary and local elections. The author has defined the electoral fund as an open one, according to the law, the partie’s or local partie’s organization or candidate’s bank account (accounts) for collecting funds on pre-election campaign. According to this abilities of an individual can be defined, and on parliamentary elections, abilities of legal entity as well, adhering to requirements of electoral legislation, in limits of maximum contribution to make a voluntary contribution to the electoral fund only in cash. Attention is drawn to necessity of legislative definition of contribution to electoral fund not only in form of cash but also in material form, including the opportunity of borrowing or taking a loan for electoral fund. The last changes in the legislation regarding receipts to the election fund, restrictions on subjects, time and ways of their introduction, responsibility for violation of the order of financial (material) support and reporting were analyzed. The author stressed practical problems of voluntary contributions to electoral funds in Ukraine that show low support of parties’ election campaigns by common citizens. The expert position of the Group of States against Corruption (GRECO) is highlighted; this concerns low quality of financial checks on election campaigns of parties and candidates. Author emphasized the gaps, drawbacks and contradictions in legislation, that cause violations in citizen’s electoral rights and those involved in electoral process. During the analysis the suggestions on improvement of payment order and electoral funds contributions control were formulated. The necessity of legislation harmonization is indicated what concerns national and local elections.
