Registration of Ukrainian ships in "convenient" registries: losses for Ukraine

Abstract

Introduction. The existence in the world of the practice of using «convenient flags» not only distorts the real picture of international shipping, but also leads to losses for some countries and for the enrichment of others. At the same time, those countries that «trade» with their flag are enriched, in fact, firstly, without fulfilling the conditions of a real connection between them and the courts; secondly, not fulfilling, in relation to international maritime law, any obligations imposed on them by conventions and treaties. Other countries suffer losses. Purpose. The purpose of the work is to study the losses incurred by Ukraine in connection with the fact that Ukrainian vessels register in «convenient» registers. Results. Ukraine, in connection with the registration of vessels of domestic shipowners in «convenient» registers and the actual loss of the merchant fleet, continues to bear not only financial but also reputational losses. In addition, the current situation has led to a slowdown in the socio-economic development of individual settlements and the complete degradation of the shipping complex of the country. This was aided by a whole pool of problems. For decades, in Ukraine, the incorrect reform of the maritime industry, which led to the loss of some ports of Ukraine, put the majority of shipbuilding enterprises at the brink of bankruptcy. Conclusion. It has been established that, despite the economic, social and geopolitical factors, Ukraine still has the potential to create acceptable conditions for registering foreign shipowners, all that is needed is political will. In addition, for the revival of the Ukrainian merchant fleet, it was proposed to adopt a package of laws based on the experience of countries whose flag is considered «convenient» («open» the Ukrainian registry or create a second international one), create the most equal conditions and tax holidays for ships under the Ukrainian flag and etc.
