REGULATION OF RELATIONS ON THE APPLICATION OF NON-STANDARD EMPLOYMENT BY THE INTERNATIONAL COLLECTIVE AGREEMENT

Abstract

The authors describe the problems of regulating relations on the use of precarious employment by an international collective agreement. It’s noted that the use of precarious employment (underemployment, distance employment, extra work) in modern realities means the inclusion of the state in the so-called “race to the bottom”, that is a specific competition between developing countries to attract foreign investment at the expense of low social costs. In this context, the international collective agreement is a form of implementing a social partnership with the participation of representatives of employees, employers and governments in the decision-making process regarding assistance and ensuring employment of the population. The authors conclude that the legitimization of the international collective agreement by the national legislation as an act of social partnership will help to stop the spread of precarious employment and contribute to strengthening the social protection of employees, increasing their living standards, preserving the balance of interests of employees, employers and the state at the global level.
