Removal of Arbitrators for Bias in the UK: Recent Case Law

Abstract

Trust in the arbitrator appointed to hear a dispute is vital for the credibility of the process. The rule against bias is one of the most basic principles of natural justice (D. Thomas, Conflict of Interest Can Be Enough for Appearance of Bias – Sometimes, Construction Law International 2016, at 32–33). This article reviews recent decisions of the English courts, which considered applications of the parties to the arbitration proceedings, submitted under s. 24(1)(a) of the Arbitration Act 1996, to remove an arbitrator on the ground that circumstances exist that give rise to justifiable doubts as to the arbitrator’s impartiality.
