Restoring statute of limitations: the right or duty of the court

Abstract
The work is devoted to the scientific study of factors affecting the restoration of limitation. The content of this judicial authority is established, which means the possibility of providing the carrier with the violated right of jurisdictional protection after the expiration of the limitation period. The features of the judicial discretion in assessing the importance of such circumstances and their impact on the impossibility of the timely presentation of the claim are determined. Concrete recommendations are given for the determination of the relevant discretionary powers.
