РОЛЬ МІЖНАРОДНИХ ОРГАНІЗАЦІЙ У ВРЕГУЛЮВАННІ КОНФЛІКТУ НА СХОДІ УКРАЇНИ: ПОТЕНЦІЇ ТА РЕАЛІЇ

Abstract
Стаття присвячена аналізу діяльності міжнародних міжурядових організацій з точки зору ефективного виконання своїх функцій у врегулюванні військового конфлікту на Сході України. Наголошується на проблемах міжнародних безпекових організацій адекватно реагувати на подібні виклики, неспроможність застарілих негнучких механізмів прийняття рішень реалізовувати міжнародно-правові норми в практичній площині. This paper dwells upon potential prospects and real obstacles encountered by the international organizations in conflict resolution in Eastern Ukraine. It is emphasized that the efforts made by international governmental organizations are the test for their ability to adapt to new global security realities and crisis caused by Russia’s external aggression. Bringing the fact of aggression into an international legal framework consideration has become one of the top priorities for the Ukrainian diplomacy since this is the only way for changing radically the situation and engaging all the mechanisms of international law support for the victims of aggression. In this context, the key factor is the reaction and attitude of the leading international organizations which, in whole or in part, bear responsibility for maintaining international piece and security (UN, OSCE, NATO, European Council, etc). However, the reaction of international organizations to the Russian aggression against Ukraine has revealed the shortcomings in taking timely and adequate decisions to resolve crisis situation as their autonomy has relative nature because of impossibility to take decisions without participation of the relevant states. For example, the UN Security Council resolutions were vetoed by the Russian Federation what practically put an end to the attempts to stop the Russian aggression. Apart from information support rendered by the majority of international organizations to Ukraine, a very small number of political actors could provide Ukraine with international legal support in practice. Despite the evident fact of aggression and its escalation, the majority of states or their political parties preferred ignoring the fact of external aggression against Ukraine by qualifying the conflict in Donbass as a civil war, trying to avoid possible confrontation with Russia recognizing the rule of force. The attitude of states has affected the international organizations, members of which they are. At the same time, some success was reached in defining Russia as the party to a conflict. It is necessary to mention the significance of cooperation of Ukraine with NATO that performs its obligations as a partner of Ukraine. Besides, it should be pointed out that OSCE SMM to Ukraine has played a great role to deliver information on the war in the Eastern Ukraine.
