RULE OF LAW: WORLD OUTLOOK AND METHODOLOGICAL REASONS

Abstract
The rule of law as a universal standard and sign of civilized legal system, a complex phenomenon which contains ideal and the real measurements is regarded in the article. A double extension of the rule of law idea is carried out: as a rule of law society and as a legal world outlook. The article is to study the deep world outlook and methodological reasons of the rule of law. The minimum foundation of legal outlook is elementary legal setting, characteristic for a person at all times: the limitations of any action by rules, principles, laws gives confidence in the future, guarantees predictable cons of their actions. Individual or collective consciousness becomes legal outlook, focusing on the rule of law, when begins to include sustainable system requirements for subject of power that supported the emotional attitude towards them. Thus, the legal world outlook is the outlook of law ruled society, the central idea of which is the rule of law. It combines the idea of human rights and democracy and is a necessary condition of citizenship as a feature of entity of legal society, which is legal personality. Philosophical core of this outlook is individualistic, rationalistic and secularized anthropology. Individualism asserts ontological primacy of the individual subject and axiological value of his freedom and autonomy. Consequently, the political philosophy established two principles: 1) political pessimism, that is the idea of inherent dangers of political power and 2) normative optimism is the belief that the risk of political power can be prevented by means of law through the totality of constitutionally guaranteed individual rights. That is such a core is the image of man as an individual possessing an ontological and axiological priority, as well as orientation on the skepticism with respect to the current government and belief in the possibility of regulatory deter of arbitrary power.
