Security and Protection of Information in Commercial Law Relationships

Abstract

The article addresses the protection of information in relationships that are entered into pursuant to commercial law and are expressed in the concepts of trade secrets, confidential information and an independent obligation to preserve confidentiality. The author points to differences between these concepts in theoretical and practical terms alike. He finds the bases for his reasoning in pertinent case law and in drawing comparisons between previous and current court opinions vis-a-vis disputes involving the enforcement of rights to the protection of information.<br/><br/>
