SOME PROBLEMS ON DISTRIBUTION OF COURT OUTLAYS AS ONE OF THE CONSTITUENTS RIGHTS OF ACCESS TO THE COURT

Abstract
The article examines the rules of distribution of court costs in the event of a party abusing its procedural rights as one of the components of the right to a fair trial. It is concluded that such a procedural instrument of influence on the participants of the process can become as a mechanism to counteract the “unscrupulous” parties and give the judges the opportunity to subjectively evaluate a particular circumstance that has taken place before and during the trial and is considered an abuse of procedural rights.
