SOME QUESTIONS OF DETERMINING THE FUNCTIONS OF LEGAL SOCIALIZATION OF A PERSON

Abstract

The article is a part of a comprehensive theoretical study of human legal socialization. The main functions of legal socialization of a person are formulated and described in it. The problem of theoretical analysis of legal socialization is complex at all levels of its scientific analysis. This is determined by the possibility of developing the theory of legal socialization of a person only if the methodology of the research is updated, the need for changing the forms of scientific thinking, which will allow elaborating the optimal theoretical and legal basis for the effective cognitive activity in the field of applied human studies. The issue of legal socialization goes beyond the scope of the legal science since the analysis of many fundamental provisions of the theory of legal socialization of a person requires the appeal to knowledge of other humanitarian, and sometimes natural sciences. At the same time, the study of any category of law is impossible without determining in the domain of the legal theory its concept, content, clarification of characteristic features, the identification of functions that are most important in a certain period of development of a society. It is the clarification of functions of legal socialization our article is dedicated to. The purpose of the article is to classify and characterize the basic functions of legal socialization of a person. Within the framework of modern scientific theoretical and legal discourse, the study of the functions of legal socialization of the person is important. Legal socialization – a multi-faceted, complicated by individual and objective influences process, which leads, on the one hand, to changes in the legal space, and on the other – to qualitative changes in the structure of the individual. To the main functions of legal socialization, we attributed the adaptation, the function of individualization and self-realization, value-orientation, communicative-information, compensatory and educational functions, the function of supporting social health, the function of ensuring the internalization and exteriorization of law, as well as the function of forming the legal identity of a person.
