Современный взгляд на проблему сущности законной силы судебного акта / The Modern View on the Problem of Essence of Judicial Act Legal Validity

Abstract
Scientific study of the doctrine of legal validity of judicial acts is carried out from the perspective of implementing functions of the judiciary in civil and arbitration proceedings. The author provides an analysis of the evolution of the civil law procedural thoughts on the essence of the problem of void judgments. The development of the doctrine of legal validity in the period of the Trial reform of 1864 and up to modern times is examined. Especially the article focuses on the comparative analysis of legal validity of judicial acts and res judicata, the author's approach of expediency of consideration of legal validity essence is argued through the eventual elimination of legal uncertainty by a judicial act. The article demonstrates that legal validity of a judicial act stems from social orientation of the judiciary and lies in eliminating legal uncertainty and promoting stability and finality of existing relationship.
