SPECIAL FEATURES OF PUBLIC SERVICE IN THE LAW-ENFORCEMENT SPHERE OF UKRAINE

Abstract

The article is devoted to the deepening of scientific knowledge about the signs of public service in the law-enforcement sphere on the basis of analysis of specific features of the relevant public service of Ukraine. Based on the legal nature of the public service in the law-enforcement sphere as a special legal phenomenon, the author proceeds to believe that this service in Ukraine pursues a special law-enforcement purpose, performs specific functions in law enforcement bodies and within the special regime and conditions of the course of service relations. It is noted that certain officials of law-enforcement bodies have normative powers, implementing, which they develop, and adopt normative legal acts that specify the provisions of the current legislation of our state in the law-enforcement sphere. It is stressed that the activity of public servants in the law-enforcement sphere is often associated with numerous risks to their lives and health, which seeks to minimize the state by providing them with a set of administrative and other public powers, the right to use physical force, provision with special means defense and protection, etc. It is concluded that the public service is characterized by the main institutional features, in particular: it is directly related to law-enforcement bodies, since it is carried out only in the bodies authorized to carry out law-enforcement activity; has a special comprehensive law enforcement purpose; carries out predominantly law enforcement activities; performs specific functions that can only be performed by the relevant public servants; carries out its activities within the framework of a special regime and in the course of official relations; has its own legal and regulatory framework; is a complex hierarchical organizational subsystem of the state; has its own system of special ranks and external attributes; consists of civil servants, who are subject to increased requirements, both at admission and during the passage of the service.
