Specific issues of objective part of crime, referred to art. 392 of the Criminal code of Ukraine

Abstract
In the article the features of the objective side of actions that disrupt the work of the institutions of execution of punishments are examined - the key features of the disposition of art. 392 of the Criminal Code of Ukraine. It is proved that the place and time of committing this crime are its obligatory features, despite their absence in the structure of actions that disrupt the work of the penitentiary institutions. Thus, According to the State Judicial Administration of Ukraine, during 2010-2016 for the commission of an offense under Art. 392 of the Criminal Code of Ukraine, convicted only 11 people; In terms of years: 2010, one, 2011, none, 2012, two, 2013, none, 2014, one, 2015, two, 2016 - five. Obviously, the number of convicts is clearly dissonant with the actual picture of penitentiary crime. The objective side of actions that disrupts the work of penitentiary institutions is characterized by a number of manifestations: 1) the terrorization of convicts; 2) attack on the administration; 3) organization for this purpose (terrorizing the convicts and / or attacking the administration) of the organized group; 4) active participation in such a group. Terrorization of convicted persons is considered to be terminated from the moment of committing acts constituting the content of terrorism: the use of violence or the threat of its application to the victims, dumb or mockery of them. The attack on the administration of the penitentiary institution may be accompanied by both physical violence and the threat of violence. Author's version of the concept of violence in the criminal-law sense is proposed. Violence means intentional unlawful use of physical force with the help of weapons and objects that can be used as weapons, other objects and substances or in the absence of such other persons, aimed at violating physical integrity or causing damage to human health or deprivation of his life.
