Стан наукової розробленості питання прокурорського нагляду за додержанням законності при проведенні негласних слідчих (розшукових) дій підрозділами Національної поліції України

Abstract
У статті зроблено спробу визначити стан наукової розробленості питання прокурорського нагляду за додержанням законності при проведенні негласних слідчих (розшукових) дій підрозділами Національної поліції України. Проаналізовано фахову юридичну літературу. Як результат проведеного дослідження зроблено умовивід, що, по-перше, комплексно питання здійснення прокурорського нагляду за додержанням законності при проведенні НСРД підрозділами НПУ на сьогодні ще не досліджувалось. По-друге, наявні роботи, у яких фрагментарно розглядалася досліджувана тематика, безумовно, слугують теоретичною основою з’ясування проблематики наглядової діяльності прокурора за додержанням законності під час проведення негласних слідчих (розшукових) дій. Водночас, беручи до уваги оновлену редакцію Закону України «Про прокуратуру», а також наявні проблеми сучасної правоохоронної практики, зроблено висновок про доцільність визначення сучасного стану наукової розробленості питання прокурорського нагляду за додержанням законності при проведенні негласних слідчих (розшукових) дій підрозділами Національної поліції. The article attempts to determine the state of scientific development of the issue of prosecutor's supervision of the observance of legality during the conduct of secret investigation (search) actions by units of the National Police. To achieve this goal, the scientific literature is analyzed, as a result of which it has been established that certain aspects of the prosecutor's supervision of the observance of the lawfulness of the conduct of the NDSD by the units of the NP were studied in the works of scientists in the areas of criminalistics, criminal process and investigative activities when considering issues related to: - prosecutor's oversight of the activities of pre-trial investigation bodies and operational units; - adherence to the lawfulness in the implementation of procedural and operational-search activities. Taking into account the above-mentioned, the author's research papers of interest of interest to a particular problem are considered in the light of the degree of research. Thus, analyzing the research at the level of theses for obtaining the degree of the Doctor of Legal Sciences, it is stated that the problems of the prosecutor's supervision of the observance of legality during the conduct of the NDSD by the units of the NP were considered in the context of studying the general issues related to the holding of secret investigative (search) actions. At the same time, studying scientific works at the level of candidate's theses and monographic studies made the conclusion that the issue of prosecutor's oversight of the observance of legality during the conduct of the NDSD by the units of the state of emergency was not yet sufficiently investigated, but only disclosed the separate concepts, principles and content of the activity during the study other issues. This is due to the fact that the subject of these studies well was the coverage of the problem. With regard to the results of the analysis of scientific works at the level of textbooks, manuals and lectures, it is concluded that in the studies conducted at the specified level aspects related to prosecutor's supervision of the observance of the rule of law during the conduct of NDSD units of the NP, for the most part the subject of the selected topics is rather superficially considered, only in accordance with the provisions of the applicable legislation. By the way, a similar conclusion was made and analyzed the research at the level of scientific articles. At the same time, it was noted that the topics of the prosecutor's oversight of legality during the conduct of the NDSD by the units of the NP were also fragmented in scientific papers devoted to the general questions of the theory and practice of the criminal process and operative-search activity. As the conclusion is substantiated, it is stated that the issue of implementation of the prosecutor's supervision over compliance with the NCDs by the units of the National Defense League has not yet been investigated yet.
