State registration of normative regulations: models of dualism

Abstract
The article is devoted to highlighting problems existing in the sphere of state registration of normative legal acts. The available duality models registration of normative legal acts are revealed in Ukraine. The question of responsibility of specific person for their have been creating administrative acts is researched. Expanding the functions of the Ministry of Justice of Ukraine leads to the fact that the state registration of legal acts are are actually being included in the stage of legislative activity: drafting legal act, as the Ministry of Justice of Ukraine has the right to actively influence the content of the decision adopted by the executive authority. The current situation with too extended powers of the Ministry of Justice of Ukraine causes the effect of “flow” of authority and responsibility for the decisions that are submitted for state registration of ministries and other executive bodies to the Ministry of Justice of Ukraine. One of the main functions of the Ministry of Justice of Ukraine should be a function of training those responsible executive agencies rulemaking activities. Perspective and promising it is determined developing and adoption of a single legal act, which would regulate the procedure of preparing and making administrative decisions of public authorities.
