STATE REGULATION OF THE INTERACTION BETWEEN JOINT INVESTMENT INSTITUTES AND ASSET MANAGEMENT COMPANIES IN UKRAINE

Abstract
The article is devoted to the study on state regulation of the interaction between joint investment institutes and asset management companies in Ukraine. Substantiated the need to establish the interaction between joint investment institutes and asset management companies as stimulant precondition of joint investment development in context of its state regulation. Emphasized the need to stimulate the development of joint investment institutes and asset management companies as investment institutions that have legal rights to collectivize the capital and to distribute risks. The points of views on the essence of joint investment institute as scientific term and legal institution are analyzed. Detailed the key points of Law of Ukraine “On Joint Investment Institutes” that ae important for interaction with asset management companies. Proved the need to create the clear legal definition of the asset management aim for joint investment institutes that is the subject of interaction with asset management companies. Noted the specifics of interaction between unit and corporate investment funds and asset management companies that are defined by their legal nature. The differences in subjective asset management system in unit investment funds and corporate investment funds are analyzed. Special attention is given to the innovations in the Ukrainian legislation on the issue and circulation of securities that are important for interaction between joint investment institutes and asset management companies. Offered author’s definition of interaction between joint investment institutes and asset management companies that is based on the principles of state regulation with emphasis on the cooperative, effective, legitimate and mutually beneficial interaction between joint investment institutes and asset management companies in Ukraine. Made the conclusion that the interaction between asset management companies and joint investment institutions is a complex and multi-faceted process and the effectiveness of state regulation affects saving of assets and increasing capital. Saving capital and raising assets is the subject of cooperation between asset management companies and joint investment institutions. So, further research needs to be directed to solving existing problems of state regulation of interaction between asset management companies and joint investment institutions.
