Abstract

The paper discusses the legal status of housing communities in the context of the legal regulations in force. In particular, case laws and opinions of legal theorists on the legal status of housing communities are analysed. Th e paper supports the view that the housing community should not be deemed an unincorporated entity. It also briefly presents the rationale behind this opinion and the proposed amendments aiming at an unambiguous definition of the status of housing communities in Polish law.
