Abstract
Artykuł dotyczy zastosowania zasad prawnych przy ustalaniu stanu faktycznego w postępowaniach sądowych. Pierwsza część, składa się z pewności prawnej, którą można rozumieć na różne sposoby. Ponadto nacisk kładziony jest na różne normy prawne, na przykład, gdzie można znaleźć ważne reguły prawa oraz informacje, że problem ten może mieć wiele aspektów. Analiza nie wykracza poza decyzję opartą na standardzie ustawodawstwa krajowego. Opiera się on na informacjach o aktualnej sytuacji i perspektywach poprawy modelu ochrony środowiska.<br/><br/>
