SUBJECTIVE ASPECT OF TERRORIST ACT COMPONENTS: PROBLEMS OF CRIME CLASSIFICATION

Abstract
The article is devoted to the problems of determining the subjective aspect of a terrorist act at the crime official classification. It has been noted that a number of difficulties in investigative and judicial practice is due to the imperfection of Part 1 of Art. 258 of the Criminal Code of Ukraine in part of defining the terrorist act purpose. Specifying the purpose of the terrorist act in kind of violation public security in the procedural documents has been acknowledged as in appropriate. The author says that threatening the population is an intermediate purpose of committing socially dangerous act and therefore the presence of another purpose of the accomplished terrorist act is recommended to be proved in court decisions (court sentences).
