СУЧАСНИЙ СТАН НОРМАТИВНО-ПРАВОВОГО РЕГУЛЮВАННЯ ЗАПОБІГАННЯ І ПРОТИДІЇ КОНТРАБАНДІ ТА ІНШИМ НЕЗАКОННИМ ПЕРЕМІЩЕННЯМ ТОВАРІВ ЧЕРЕЗ МИТНИЙ КОРДОН УКРАЇНИ

Abstract
У статті здійснено спробу дослідити сучасний стан нормативно-правового регулювання запобігання і протидії контрабанді та іншим незаконним переміщенням товарів через митний кордон України, теоретичні та практичні підходи до розв’язання проблем боротьби із зазначеними правопорушеннями. The article is an attempt to establish the current state of the main problems and ways to improve the normative-legal regulation of preventing and combating smuggling and other illegal movement of goods across the customs border of Ukraine, to identify the theoretical and practical approaches to the prevention of marked violations of law. It is established that in the present economic and political situation in the country, there is a significant growth in the volume of smuggling and other illegal movements of goods across the customs border that is a significant threat to the state's economy. Responsibility for the illegal movement of goods across the customs border delimits on the subject of the offenses, the legislation provides criminal and administrative responsibility for committing them. Based on the analysis of the decriminalization of offenses in the customs sphere it specified that along with socio-economic and criminogenic factors as the spread of the negative effects and the consequences that lead to guilt, maybe the leniency of responsibility itself, is one of the factors increasing the number of specified offenses. Conclusions are made about the need to overcome the mentioned factors by the further improvement of legal regulation in this sphere, especially with respect to preventing the commission of these offences, namely: at the level of inter-state cooperation to effect the unification of the subject of offences on illegal movement across the customs border; to strengthen the responsibility by expanding the subject of crimes of smuggling of certain group of goods, values, currency in large (especially large) size and increase the responsibility for the commission of the relevant offences.
