SUPERVISION OVER ADVERTISING OPERATIONS: SOME CONTROVERSIES IN LEGAL REGULATION

Abstract

The article analyzes the procedure for the control actions in the field of advertising. Special focus is placed on the controversies that that has emerged from the inconsistency of the general legislative norms related to the supervision in the field of commercial activity, as well as specific advertising legislation. The author examines two main positions, developed by judicial practice. Based on the results of conducted research, the author suggests ways to improve the advertising legislation with an aim to establish the proper functioning of the supervisory authorities and ensure the rights and legitimate interests of citizens in the advertising field.
