Techno - doping legal and ethical aspects

Abstract

Continuous fight for sport’s quality has been taking place throughout the last several decades, which is a result of morally weakened construction of sport. One of the most significant battles is taking place on legal field (but not only) and pertains to doping, which, in a way, has its roots in the aspiration for perfection, - "Citius Altius Fortius". However, this aspiration breaches legal regulations. Doping creates situations when sport no longer educates but corrupts. Fair play is vanishing, it is no longer the most valuable and prominent moral rule. Of course there is no doubt that doping is one of the highest threats to sports competition based on fair play basis. And techno-doping is one of the most controversial issues in sport. Legal aspect of techno-doping prevention in sport became one of the most significant and difficult issues of sports law. Na przestrzeni ostatnich kilku dekad obserwujemy nieustanną walkę o jakość sportu, co bez wątpienia jest wynikiem komercjalizacji i profesjonalizacji sportu i co za tym idzie osłabionej moralnie konstrukcji tej sfery życia ludzkiego. Jedna z najbardziej znaczących bitew odbywa się na polu prawnym i odnosi się do dopingu, który w pewnym sensie, ma swoje korzenie w dążeniu do doskonałości - Citius Altius Fortius. Jednakże takie aspiracje często prowadzą do naruszeń w sferze prawa i prowadzą do obniżenia standardów etycznych sportu. Sport zamiast wychowywać, wypacza. Doping jest aktualnie jednym z największych zagrożeń dla sportowej rywalizacji opartej w założeniach na zasadzie fair play. Nie ulega wątpliwości, że tak zwany techno-doping jest jednym z bardziej kontrowersyjnych i ekscytujących problemów szeroko pojętej polityki antydopingowej. Zagadnienie to stanowi element ogólnoświatowej debaty na temat kształtu relacji pomiędzy sportem a prawem oraz ideologią transhumanistyczną. Stanowi pole, na którym ścierają się różnorodne koncepcje dotyczące interwencjonizmu państwowego, światowego w sferę sportu.
