Abstract
In the article judicial practice of consideration of modus operandi as corpus delicti sign is considered at purpose of punishment in the courts of the first instance located on the territory of Ukraine for 2010-2015. Identified gaps and contradictions in the practice of criminal proceedings and ways of its improvement are offered. В статье рассмотрена судебная практика учета способа совершения преступления как признака состава преступления при назначении наказания в судах первой инстанции, расположенных на территории Украины за 2010-2015 годы. Определены недостатки и противоречия в проанализированной практике уголовного судопроизводства и предложены пути ее совершенствования.
