ТЕОРЕТИЧНЕ ОБГРУНТУВАННЯ ДІЯЛЬНОСТІ СПОРТИВНОГО АРБІТРАЖУ ТА ПЕРСПЕКТИВИ ЙОГО СТВОРЕННЯ В УКРАЇНІ

Abstract
Introduction: The international experience of sports arbitration is useful for creating a permanent sports arbitration institution in Ukraine. After all, today in Ukraine, the issue of creating a single sports arbitration body has not yet been resolved. Despite the fact that in 2004 the Law “On Arbitration Courts” was adopted, its extension to the sphere of sports activity has not been implemented to date. This limits the rights of our athletes both within our state and in the international arena. Today, there are all the necessary conditions to solve this problem: the availability of modern technology, developed the foundations, methods, principles of the general theory of selforganizing systems. This will provide an objective assessment of the causes of conflict situations, will allow you to create a single legal organization in the field of public law, designed to respect the rights and freedoms of Ukrainian athletes. Purpose of the study: theoretically substantiate the main advantages and principles of sports arbitration based on the provisions disclosed by the general theory of complex self-organizing systems, and determine the prospects for its creation in Ukraine. Material and methods: theoretical analysis and synthesis of data from scientific and methodological sources used to determine the problem field of functioning of sports arbitration. To create a theoretical basis for the functioning of a sports arbitration body, methods of induction, deduction, structural-functional analysis, synthesis, synthesis, comparison, abstraction, analogy, historicism are applied. The expediency of using the method of mathematical modeling in the process of building an effective management system is substantiated. Results: the use of the basic principles of the theory of the functioning and development of self-organizing systems allowed to analyze the main advantages of the activities of arbitration and arbitration courts abroad and determine the prospects for creating a single sports arbitration body in Ukraine. Conclusions: the advantages and principles of sports arbitration practice are defined. The control system «environment – object of management – the subject of management» is characterized. An algorithm for the establishment of stationary signals (conflict situations) is proposed. The established positions are objectively justified in the general theory of complex systems. The prospects for creating a single sports arbitration instance in Ukraine are defined: use of positive foreign experience in sports arbitration activities; the adopted Law of Ukraine “On Arbitration Courts”; the possibility of attracting specialists in the field of physical culture and sport
