THE ACTIVITY OF THE JOINT COMMISSION FROM 1989 TO 2008 AS A MANIFESTATION OF DIALOGUE BETWEEN CHURCH AND STATE IN LIGHT OF SELECTED ISSUES

Abstract
Poland, after the political transformation in 1989, saw the normalization of the relations with respect to individual churches and religious denominations. An indication of that state of affairs was the adoption of a clear legal basis for the Joint Commission of the representatives of the Government of the Republic of Poland and the Conference of the Polish Episcopate, in accordance with art. 4 of the act of 17 May, 1989, on the relationship between the State and the Catholic Church in the Republic of Poland. The main objective of the Joint Commission is to examine the problems related both to the development of Church-State relations and to the interpretation and execution of the afore-mentioned act. From 1989 to 2008 the Joint Commission gathered 32 times, and among the most frequently discussed issues one can enumerate those concerning Church estates and religious education at school. Also some current matters typically appeared on the agenda. One ought to emphasize that despite the new reality after 1989, the atmosphere within the Joint Commission differed depending on the changes in the political arena. Nevertheless, owing to the above-mentioned act on the relationship between Church and State, the Joint Commission gained the statutory basis of its existence and activity, and constituted a plane of dialogue between the Government and the Episcopate, irrespective of the ruling party. The main value of the meetings of the representatives of the Government and the Episcopate lay in appointing bilateral teams who worked on preparing solutions which could finally prove acceptable to both negotiating parties.
