THE ACTUAL ISSUES OF THE MODERN CRIMINALISTIC CHARACTERISTICS OF THE TERRORIST ACTION: PERSONALITY OF CRIME

Abstract

In the article, on the basis of modern forensic analysis, taking into account the current domestic counter-terrorism practice, an element of the forensic characterization of a terrorist act is analyzed as a terrorist's person. The necessity of perfection of the corresponding criminalistic methods and formation of the updated forensic characteristics of the analyzed crimes is emphasized. The relevance of the research of the socio-psychological portrait of the personality of the terrorist is considered in the light of current trends. It is noted that information about the identity of the offender established during the investigation creates new independent information, which allows to correctly determine the direction and methods of seeking a criminal, to nominate and verify typical investigative versions, to identify the circumstances that constituted the crime, to choose the most effective tactical methods of questioning the suspects and adopt other tactically correct decisions in the course of investigating a particular crime. The author systematized the main scientific approaches to the study of problems in the aspect of studying a group of criminologically meaningful properties of the offender. It is determined that it is expedient to include in the forensic description of the terrorist's person the information about the motive of committing terrorist activity, general biological data, information about social properties of the person, information about personal qualities and psychological peculiarities, information about the behavior of the suspect before, during and after the crime. Some typological characteristics of the person of a terrorist are shattered: those who commit a terrorist act on the basis of national hatred and those who commit a terrorist act on religious beliefs are described. On the basis of the analysis of investigative and judicial practice, certain conclusions were drawn regarding the generalized criminalistic portrait of the terrorist's person and outlined ways for further study of the problems.
