Abstract
The systematic human being in the society and the following of rules is a vital role for the continuation of life . The assassin of heinousness of castigation without statement is an important and inevitable rule before the Islamic jurists and fundamentalists . Since Islam enjoys a universality in all spheres of life , it can provide whatever necessary for a perfect life for all human beings . The assassin of heinousness of castigation without statement means that while an action is not prohibited and that action is not announced to all people , its punishment is reasonably obscene . During the present study , the exceptions to this issue along with its importance as a subject matter of which all people are required to be aware of is investigated and explained and is compared with the legitimacy of punishment . From the view of jurisprudence , the explanation of rules and orders for the common people is circumstantial evidence of judicial since it is taken for granted that people are completely aware of them . Moreover , the legislator has also proved and distributed the law in a lawful manner . So it is now a basis for common knowledge of people and no excuse as to its awareness is not accepted .
