The digital worker, between inclusion and protective exclusion

Abstract

This article analyses the legal nature of the work carried out through the Uber digital platform, as well as the different problems this type of work poses. For this, the Judgment Uber BV and others (Appellants) v Aslam and others (Respondents) (Supreme Court of the United Kingdom, case: UKSC 2019/0029, 2021) will be reviewed in detail. The scope of the recitals of this judgement will be extrapolated to the Colombian context, stating that, given the sui generis conditions of this type of occupation, it is necessary to review the norms that regulate both dependent and independent human work.
