THE FAILURE OF THE NEGOTIATING PROCESS IN THE COLLECTIVE LABOR LAW A FEW WORDS

Abstract
In this article I analyze the effects of the breach of good faith during the negotiations leading to the conclusion of collective agreements . `e obligation to negotiate in good faith is deeply rooted in the same principle of social dialogue. In contrast to the views of the majority, I believe that a violation of the principles of social dialogue can lead to the recognition of collective agreements ine_ective. To justify this thesis appeal to the axiology accompanying both the legislative process and the conclusion of civil law contracts . I will also defended the thesis on the admissibility of the application of Art. 8 KP for evaluating the negotiation process.<br/><br/>
