The implementation of positive foreign experience of legal protection of commercial information in the financial legal relations

Abstract
This research is aimed at determination of the specific features of using successful foreign experience in legal protection of commercial information in financial and legal relations for further use in the legal framework of Ukraine.The article analyzes the issues related to implementation of positive experience as to ensuring protection of commercial information in financial and legal relations. The specific features of interaction between the state and the business in this area have been determined. The benefits and drawbacks of domestic legislation governing commercial information protection have been outlined. The research of the approaches to the sources of legal regulation of relations in the area of the use of commercial secrets in foreign countries evidences the lack of the common approach in this matter. Every country when developing and supplementing the standard provisions of international legal acts related to governing the relations in commercial secrets chooses its own way of setting the legal tools as to their regulation. Depending on the forms of external expression and systematization of legal norms governing the relations connected with commercial secrets relations, in the law of foreign countries, the legal framework for regulating these relations make constitute special regulatory legal acts encompassing the majority of aspects for regulation of relations in commercial secrets, codified regulatory legal acts that consolidate the provisions related to regulation of relations as to commercial secrets, regulatory legal acts on protection against unfair competition, local legal acts, legal doctrine, court decisions. This article substantiates the advisability of strengthening the fundamental role in the use of commercial secrets that will allow for enhancements of efficiency and effectiveness in legal regulation of relations connected with the use of commercial secrets in business, achievement of the internal unity of the current legislation, streamlining and improvement of its content by eliminating conflicts and drawbacks.
