The international legal concept of patient protection

Abstract
The article analyzes the norms of current legislation, justified the conclusion about the need to improve the legal regulation of criminal law protection of the rights and legitimate interests of the patient. The author characterizes the international legal standards for protecting the rights of patients, justifies the desirability of overcoming the existing problems of legal regulation of patient rights through the development and adoption of the Law of Ukraine “On the Protection of Patients’ Rights and Freedoms”, in which it is appropriate to determine the status of patients and introduce a special mechanism to protect their rights. It is noted that the necessity of determining the system of guarantees of the protection of the rights of patients is determined, first of all, in a predefined condition of the person from the doctor, which is explained by the absence of a person with special knowledge of the disease, about the established procedural features of the treatment. The purpose of this study was to determine the essence of the international legal concept of protecting the rights of patients in order to find ways to implement it in Ukraine. The article focuses attention on the fact that the basis of international legal protection of patients’ rights is primarily respect for his dignity, ensuring the necessity of ensuring his physical and mental integrity, regardless of any discriminatory features, including the property situation, the realization of which in in its totality, allows proper implementation of human rights to health care. The study concludes that the development of European legislation aims at establishing a good dialogue between the patient and the doctor, between the patient and the medical institution, which results in an increase in the level of protection of human rights and freedoms.
