THE ISSUE OF DISMISSAL AN EMPLOYEE FROM WORK DURING THE NOTICE PERIOD

Abstract
The study aims at addressing the issues regarding a release of employee from the duty to perform work within a notice of termination period. As the issues are not uniform, a separate analysis of the release from the duty to perform work was made depending on whether the release is based upon the mutual agreement or employer’s unilateral decision. The study also describes the form of the release from the duty to perform work, remuneration for the period of release, employee’s obligation to take vacation leave and an admissibility of court proceedings in vindicating claims.<br/><br/>
