THE LEGALITY AS THE CRITERION FOR SUPERVISION OF LOCAL GOVERNMENT – IUS OR LEX?

Abstract
The article raises the issue of the perception of legality as the criterion for supervision of local government in Poland. The introductory part presents the concept and regulation of local government in Poland. Characterized by the concept of supervision, pointed out the difference between supervision and control and found in the regulations criteria of supervision, including the constitutional and statutory regulations. In the right analyzed J. Zimmermann’s argument talking about the perception of legality as compatibility with the legal system, at the same time, taking into account the particular legal norm, which formed the basis for action. At vindication for the J. Zimmermann quoted a number of reasons, among which the most important was that resulting from the constitutional.<br/><br/>
