THE MAIN DIRECTIONS OF IMPROVEMENT OF THE CONSTITUTIONAL AND LEGAL PROVISION OF THE RIGHT OF EVERYONE TO APPLY FOR THE PROTECTION OF THEIR RIGHTS AND FREEDOMS TO INTERNATIONAL JUDICIAL INSTITUTIONS OR BODIES OF INTERNATIONAL ORGANIZATIONS

Abstract
The article is devoted to the identification of the main directions of improvement of the constitutional regulation of right to apply to the international judicial institutions or bodies of international organizations for protection of human rights and freedoms. It is proved that such areas are the definition of significant harm caused to the applicant, the identification of related evaluation criteria of its presence or absence; implementation of the principle of “de minimis non curat praetor”; obligation of the state executive service to transfer the things from which filmed the arrest, to the proprietor and the procedure of such a transfer in the legislation of Ukraine. It is proposed to amend Art. 60 of the Law of Ukraine “On Enforcement Proceeding”.
