The Offender’s Sex vs. Liability for Crimes against Life and Health

Abstract

The principal objective of criminal law is that of penalizing certain behaviors, i.e. performing the punitive function. Society expects institutions of the state to respond in a similar manner to similar infringements on law-protected rights and values. Hence, any discrimination by criminal law between crimes and sanctions should be carefully premeditated and based on a sound rationale. Arguably, gender is particularly vulnerable to all forms of discrimination. It should therefore be presumed that gender will not bear on the extent of criminal liability or the ensuing penalty. However, there are types of crimes against life and health where this is not the case. The chapter tries to establish why discriminatory practices take place and inquires into whether disparate treatment under criminal law relates to sex or gender.
