The open and high-security state prisons in the penitentiary system of Denmark

Abstract

The article analyzes the stages of Denmark prison reform during the XVIII–XXI centuries. Legal and organizational rules for the penitentiary and prison convicts. The prison system of the Kingdom of Denmark in the XVII century consists of the home detention, the prison with forced labour for dangerous criminals, the workhouses for homeless, beggars and petty criminals that later turned into a manufactory of forced labour with a view to profit. According to the Royal decree 1842 both Auburn and Pennsylvania institutions were to be constructed and form the basis of the forthcoming Danish prison system. Denmark’s penitentiary system is subject to the Directorate of Prisons and Probation of Denmark. It has been determined which penitentiary institutions have been active in one or another period, the legislative provision of the penitentiary sector, the location of all institutions in the regions of Denmark, the principles of activity and departmental subordination to the Ministry of Justice. It has been established that each of the four regional departments of the Directorate of Prisons and Probation is subordinate to: open and closed prisons, arrest houses, correctional institutions, hostels and probation centers. The prisoners attend classes, work a standard Danish workweek (37 hours), and even do their own shopping and cooking. Married couples are often allowed to live together and even with their children if under 3 years old. The result, seemingly, is an extremely low rate of recidivism. Inmates are able to easily transition from prison to everyday life. The author outlines the general features of the regime of detention in the penal institutions of Denmark, in particular, the order of the day of the convicts, the order of arrival in the institution and the appointment of the program of serving a sentence, the possibility of leaving the institution on weekends, living conditions, etc. The peculiarities of the functioning of closed and open-type institutions, the functioning of family departments in the latter, and strengthened supervision facilities in closed-type institutions are also identified. Detailed attention is paid to the most advanced prison in Denmark – Storstrøm.
