THE QUESTION OF THE EXISTENCE OF THE STATE'S RIGHT TO PREVENTIVE SELF-DEFENSE

Abstract
In the article, the author analyses the main doctrinal positions concerning the question of the existence of right to preventive self-defense. This question is described through the lens of teachings of the most highly qualified publicists in the sphere of international law and practice of the International Court of Justice. Article brings attention to modern problems in state practice. It points out all possible arguments, which support or disapprove the possibility of existence of such right. The author provides an answer to this question.
