THE REGAINING OF THE PROPERTY OF THE LUTHERAN CHURCH IN THE CITY OF GDANSK AFTER 1989 (PROCEEDINGS BEFORE THE REGULATORY COMMISSION)

Abstract
When evaluating the process of regulation of property matters of the Lutheran Church after 1989 in the city of Gdańsk, it should be stated that the church has taken considerable advantage of regaining former evangelical property in the urban area. The relevant applications were submitted immediately the right of regaining became effective and were answered in a relatively short time. The effects of these attempts were comparatively satisfactory, yet far from most favourable. Due to a former seizure of the most prestigious and attractive evangelical church property by other religious associations (predominantly by the Roman Catholic Church), the Gdańsk Lutheran parish had but a mere chance to take possession of interesting church property in the city. From among 9 submitted applications involving at least 10 sites, only one was regained according to the application: the tower of a war-torn church. In lieu of other sites, the Lutheran parish was offered the property situated outside the former sacred and evangelical site. Taking into account a many centuries’ leading position of Lutheranism in the Gdańsk religious forum, the result of the regulatory proceeding appears far from adequate. In the course of the proceedings, a stance adopted by the representatives of the Lutheran Church was realistic and reticent. In most sensitive cases the applicant exercised tact, which was corroborated by the withdrawal of the application concerning the complex of Mikołaj Kopernik Hospital.
