THE RIGHT OF UKRAINIAN CITIZENS WORKING ABROAD ON PROTECTION AGAINST UNEMPLOYMENT IN THE SYSTEM OF SOCIAL INSURANCE

Abstract
field of realization of right to protection against unemployment of Ukrainian citizens working abroad and don’t insured in the system of social insurance against unemployment in the country were such employees are located. Analysis of resent researches and publications. The following scientists have been involved in development of mentioned problem: O. V. Basai, M. I. Bodnaruk, N. B. Bolotina, I. O. Gumenyuk, M. I. Inshyn, R. I. Shabanov, V. V. Yurovska. Article’s main body. According to the current legislation in the field of social insurance against unemployment the citizens of Ukraine working outside Ukraine and don’t insured in the system of social insurance against unemployment in the country where they work, have the right to the social insurance against unemployment by paying insurance contributions, unless otherwise provided by international treaty of Ukraine. However, in case of changes that had been made to the legislation on charging a single fee for social insurance against unemployment above mentioned persons excluded from the category of subjects who volunteer are eligible to participate in the social insurance against unemployment. To overcome the current conflict it is necessary to clarify the nature and scope of legal regulation of laws that contain the conflict of law provisions. The emergence of legal conflicts is an obstacle to resolve not just purely legal problems (regulation of subjects’ behavior), but also social goals receiving. Some legal conflict can directly affect public institutions, As a general rule, the social insurance is divided into two types: voluntary and mandatory, there is no separate legal act that would regulate and introduced the issue of voluntary social insurance. It is generally accepted trend that the question of voluntary social insurance is regulated by providing the opportunities to participate in the system of compulsory state social insurance on a voluntary basis. Conclusions and prospects for the development. To ensure the constitutional right of individuals to protection against unemployment, people who work outside Ukraine and do not insured in the system on social insurance against unemployment in the country where they work, they have the right to voluntarily participation in the system of compulsory social insurance against unemployment.
