The Right to Health. Consequences on the Fair Allocation of Health-Related Resources

Abstract
Keeping a close watch on human rights is not enough to address detailed distributive questions such as who gets what and how much in some given circumstances. Neither can the right to health solve concrete allocation problems which arise in times of scarcity. The reason for this is the lack of consensus on the deeper layer of our firmly held moral beliefs, the fact that some questions of distributive justice are affected by disagreement on the moral principles at stake. This reasonable pluralism of the conceptions of the good can be properly dealt with by means of a political conception about justice (Rawls). Rights are corner-stones in setting the background for the deliberative process, the institutional design and the coercive legal ways, as well as the noncoercive measures suitable to tackle the issue of the fair allocation of health-related resources.
