The tactical peculiarities of the questioning of persons with signs of violation of the psyche

Abstract
The article is devoted to the actual problem, important both for legal science and legal activity in the part of implementation of modern criminalistic methods and recommendations for conducting interrogations of persons with mental deviations of different etiologies. We hope to realize the accumulated potential in the direction of positive correction for scientific representations in the essential definition of the subjects of forensic psychiatry, neurology, etc., in particular, in relation to the true causal differences of external appearance manifestations of deviations on the basis of the current vision of the nature of the phenomenon of the psyche in terms of energy and information, which in the future development of science will be the basis for systematizing the features sufficient for the visual rapid analysis of mental states and their behavioral manifestations by subjects of judicial proceedings. In order to sub-stantiate the author’s point of view on the problem, an integrated approach has been applied: the synthesis of information and practical data on scientific and contemporary advances in the fields of quantum physics, biology, criminology, medicine, psy chology, which is focused on just subject problems, without which it is impossible to solve the problem – to draw up an effective forensic method of interrogation of persons from hypothetical signs of mental disorder. In this, the author sees the cre¬ation of real conditions for proper legal proceedings, the provision of constitutional principles for the protection of human rights, and the facilitation of conditions for the professional activities of investigators, in particular, regarding the adoption of decisions on the introduction of forensic methods of conducting interrogations of subjects suspected of their mental abnormal condition. This study are devoted to the attempts to make an analysis of modern ideas about the psychic mechanism, its certain functions in the mode of “norm” and deviations from the projection of concepts: “consciousness”, “intelligence”, “will”, which in the legal qualification of the nature and the form of guilt, and therefore the general definition of the individual’s sense of sanity are fundamental.
