THE UNITY AND DIFFERENTIATION OF NORMS OF LABOR LAW GOVERNING RELATIONSHIP BETWEEN YOUTH WORKING

Abstract

The author reveals the question of the unity and differentiation of labor law norms, devoted to the legal regulation of youth employment. It’s determined that age as a feature inherent in the subject, which is recognized by the state as a criterion of differentiation in the legal regulation of labor is a rather complex characteristic, because the definition of a specific age category is related to the specifics of the place of the latter, which is based on objective criteria of the physiological capabilities, that are related to it. The author notes that the aim of differentiating the norms of labor law is to equalize the rights and opportunities for their implementation, despite the objective characteristics of the individual, the factors of work, etc. The author believes that the purpose of differentiation, which is the basis for the employment of young people, is determined by the appointment and content of employment and the specifics of this age category. This aim is manifested in the norms of law, dedicated to assistance in determining the scope of their professional direction and providing the opportunity to get a job for a certain period, necessary to gain experience and professional self-confidence.
