Theoretical and legal analysis of the Ten Commandments of God as a world-wide source of positive law

Abstract

The article deals with the problem of the formation of the idea of law in the context of the Judeo-Christian worldview tradition. The concretization of judgments of Judaism and Christianity in the sphere of the moral and ethical complex is analyzed. The dominants of its meaningful filling are found out in accordance with the process of comprehending the idea of law. Today there is no single comprehensive study of the peculiarities of the formation of the idea of law in the context of the Judeo-Christian tradition of world perception. It is precisely at the present stage of state-building that it is necessary to specify the decisions of Judaism and Christianity in the sphere of moral and ethical complex, to find out the dominant of their content content in accordance with the process of comprehension of the idea of law. Also, it is advisable to consider the symbolism of Old and New Testament texts, which give rise to multiplicity in the field of their interpretation and the plane of interrelationship between the understanding of the social purpose of morality and law. Since the Bible consists of the Old Testament (the Scriptures of the Jews) and the New Testaments, it is appropriate to consider those aspects of the doctrine of Judaism, which became the basis of the moral life and legal tradition of the Jewish people, with the prospect of their further history and analysis of the questions expressed in Christianity. In the basis of all religious, and then the legal culture of the Jewish people, the Holy Scripture – the Torah (the Christian equivalent – the first 5 books of the Bible), which is regarded as an invaluable gift of the Most High. Among the representatives of the people, it is known as the Divine Law. It is believed that the Lord gave his ordinances of life to the Jews through the prophet Moses, and therefore another variant of the name – The Ten Commandments of God. The fault was intended to regulate all aspects of society’s life, from relationships within the family, to the affairs of the organization of social institutions. Their norms together form a treaty that God made with the Selected People. Among the representatives of the Jewish people, it is believed that the very term of the contract – with the mutual obligations of the parties – is to the greatest extent corresponds to the essence of the event. Thus, the people were obliged to perform the will of God, and the Lord himself promised in the fulfillment of His requirements of goodwill and support. The informative center, which focuses on the data of world-wide and moral requirements, which become the basis of the regulatory mechanisms for the life of Jews throughout their history, is the 10 commandments or the Decalogue.
