Theory of law as a sphere of national urisprudence: the problem of formation subjects and functions

Abstract
Positive and negative factors of development of the national general theoretical jurisprudence are defined in the article. It is stated that the soviet-legal tradition of the vision of the subject of this science as a dual has not yet been rejected. The necessity of delimiting the theory of law from the theory of state is justified by the european integration aspirations of Ukraine. The theory of law is considered as an independent legal science, a system of scientific knowledge about the essence and social purpose, patterns of the emergence, functioning and development of law. It has been found out that the theory of law is in its essence social science, and in the system of legal sciences it is general, methodological, fundamental, generalizing and forecasting. The subject of her study is the law as a specific social phenomenon, and legal categories, concepts, theories, tendencies, legal consciousness, legal culture. The purpose of this science – the accumulation and systematization of knowledge about the law and phenomena associated with it, and the development of ways to solve problems of legal theory and practice. Appointment of the theory of law as a science is specified through its functions – the main directions of influence on theoretical jurisprudence and legal practice. All functions are interconnected, implemented in a comprehensive manner. Conditionally, they can be divided into two groups: general – characteristic of the theory of law as any sphere of knowledge; special – inherent purely the theory of law as a science, reflect the peculiarities of its subject matter. Functions of the first group are: cognitive, analytical, axiological, prognostic, scientific-applied, ideological and educational. The functions of the second group include: accumulative, system-oriented; methodological. It is noted that the theory of law as a science is at the initial stage of its development, its place in Ukrainian jurisprudence is not yet defined, however, the separation of the theory of law from the theory of the state on specific subjects and their separate research today is an urgent necessity.
