TO THE ISSUE OF CERTIFICATION BY THE NOTARY OF A COMPETING CONTRACT

Abstract
The article is devoted to the establishment of de facto husband and wife property relations and the regime of sharing on property earned in concubinage. The experience of foreign countries and judicial practice in Ukraine as to ascertainment of the fact of living as one family without registration of marriage and the origin of the regime of joint property are analyzed. The author pays attention to the necessity of Family code variation in Ukraine that provides consequences of law husband and wife residence in unregistered marriage.
