TRăSăTURI ALE PERSONALITăŢII INFRACTORULUI MERCENAR, CETăŢEAN AL R. MOLDOVA – STUDIU CAZUISTIC

Abstract
Activitatea mercenarilor, incriminată la art. 141 C. pen. al R. Moldova, este una dintre cele mai răspândite infracţiuni care atentează la regulile de ducere a războiului instituite de dreptul internaţional umanitar. Practica judiciară ne demonstrează că, în aceste activităţi infracţionale, sunt implicaţi şi cetăţeni ai R. Moldova. Acest lucru este determinat de conflictele regionale în derulare din anumite state, precum este și statul vecin Ucraina. Studierea trăsăturilor personalităţii infractorului este o premisă indispensabilă pentru prevenirea eficientă a fenomenelor criminale, printre care se înscrie şi activitatea mercenarilor. Acest lucru ne-a determinat ca în prezentul studiu să analizăm unele determinante biopsihosociale ale personalităţii infractorului mercenar, cu referinţă specială la cetăţenii R. Moldova implicaţi în asemenea practici criminale.
